All information obtained by Auricula’s Garden for the purposes of processing an order is kept private and never shared with other companies for marketing purposes.

Trading Terms & Conditions

Auricula’s Garden is the Seller.

Buyer means the person[s] or firm who purchases Goods from the Seller.

Conditions means these terms and conditions.

Goods means the goods set out in the Order and to be supplied by the Seller to the Buyer.

Order means the Buyer’s order for the Goods from the Seller.

The Conditions apply and form part of the Contract between the Seller and the Buyer. They supercede any previously issued terms and conditions of supply.

No variation of the Conditions or to an Order, or to a quotation from the Seller will be binding unless expressly agreed in writing and executed by a duly authorised signatory on behalf of the Seller.

The Seller reserves the right at all times to reject any Order, in whole or in part, at its sole discretion.

Each Order by the Buyer to the Seller will be deemed to be an offer to purchase Goods and subject to the Conditions.

Any quotation by the Seller for the provision of Goods shall not be an offer by the Seller to supply Goods on and subject to the Conditions; and will be will be valid for 28 days only from the date of issue.

The price for the Goods will be as set out in the Order.

Full payment is required to progress an Order. For an Order that is not being collected in person p&p costs must also be paid before the Order is dispatched.

All payments are non refundable.

Payments are processed at the time of ordering by PayPal unless being collected in person, in which case a cash payment is acceptable. PayPal is a safe and well used way of paying online, and no financial details such as card numbers are stored with the Seller. After confirming your order at the checkout you will be passed to the PayPal website to complete your transaction securely.

Price and product information is subject to change at short notice and without prior notification.

The Seller tries to ensure that all photographs and product descriptions provided on Auricula’s Garden website are accurate.  If you do spot any errors then please contact the Seller.

Unless specified items in the shop are not toys and as such may be hazardous to young children.

Great care has been taken in compiling the content of this site. However; the Seller can accept no liability for any inaccuracy, error or omission. The Seller can also accept no responsibility or liability for any damage or injury to persons or property arising from the use of any ideas or instructions contained on this site.

Auricula’s Garden reserves the right to photograph workshops, items produced at workshops and any item sold. The right is reserved also to use graphics and images on the site, blog, on Facebook, Pinterest and on Twitter. You may be tagged unless you let the Seller know by email or in writing that you do not want to be tagged. If you do not wish your work to be used for marketing purposes, please let the seller know via email or in writing.

The Goods will be delivered by or for the Seller to the delivery location on the date specified in the Order, or made available for collection by the Buyer at the Seller’s premises set out in the Order. The Buyer will collect the Goods within the period specified in the Order.

The Goods will be deemed delivered:

  • if delivered by or for the Seller, on arrival of the Goods at the Delivery Location;
  • if collected by the Buyer under clause 6.1.2, on completion of loading at the Seller’s premises.
  • The Goods may be delivered by installments. Any delay in delivery or defect in an installment will not entitle the Buyer to cancel any other installment.
  • Each delivery of the Goods will be accompanied by a delivery note stating:

1..1          the date of the Order;

1.2           the relevant Buyer and Seller details;

1.3               the product numbers and type and quantity of Goods in the consignment;

1.4 any special handling and other instructions;

(a)  whether any packaging material is to be returned (in which case the Buyer will, at the Seller’s option, return them to the Seller or make them available for collection by the Seller at a time specified by the latter, and in either case at the Seller’s expense).

(b)  The Seller will use its reasonable endeavours to meet delivery dates but such dates are approximate only, and time of delivery is not of the essence.

  • The Seller will not be liable for any delay in or failure of delivery caused by:

1.1  theBuyer’s failure to: (i) make the Delivery Location available, (ii) prepare the Delivery Location [in accordance with theSeller’s instructions] [as required for delivery [and installation] of the Goods] or (iii) provide the Seller with adequate instructions, for delivery [and installation] [or otherwise relating to the Goods];

1.2  the Buyer’s failure to collect the Goods from the Seller’s premises, or

1.3  an event of Force Majeure.

1.4  If the Buyer ails to accept delivery of or collect the Goods as provided in clause 6.1.1 or 6.1.2 on the date or within the period set out in the Order:

1.4.1  delivery of the Goods will be deemed to have occurred at [time] on the [number] Business Day following [such date/the last day of such period];

1.4.2  the Seller will store and insure the Goods pending delivery, and the Buyer will pay [[reasonable storage and insurance charges] [storage and insurance charges at the Seller’s then-applicable rate]] [all costs and expenses incurred by the Seller in doing so].

1.5  If, 28 Business Days after the due date for delivery or collection/the last day of the period for delivery or collection of the Goods, the Buyer has not taken delivery of or collected them, the Seller may resell or otherwise dispose of the Goods. The Seller will:

1.5.1  deduct reasonable storage charges and costs of resale]; and

1.5.2  account to the Buyer for any excess of the resale price over, or invoice the Buyer for any shortfall of the resale price below, the price paid by the Buyer for the Goods.

 

All items purchased from Auricula’s Garden shop are © Auricula’s Garden 2014 and may not be produced in part or full by you or a third party.

Patterns and tuition are included in the workshop price. Patterns may be shared but you may not sell the patterns on or anything that you make from them without the Seller’s permission as some of the patterns you will use are not the Seller’s own and the Seller seeks to respect the copyright of the owner.

Workshop prices are exclusive of materials unless otherwise stated. Venue and shopping lists are provided when you book. Refreshments are included in each workshop price. Some workshops need a minimum number to run so may be subject to cancellation.
